Official Photo Contest Rules, Terms and Conditions

Eligibility:

Tri-County Bank Photo Contest is open to everyone 18 years and older. There is a limit of one entry per person.

Tri-County Bank employees are not eligible to enter.

Entry Period/Voting Period:

The Photo Contest Entry Period begins at 12:00am on March 1st, 2024 and ends at 11:59pm on March 31, 2024. Entries submitted before or after the Entry Period will not be eligible. Tri-County Bank’s computer is the official time-keeping device for the Photo Contest.

Voting (Facebook “Likes”) begins on April 1st and ends on April 8th. Any Facebook “Likes” submitted before or after the Voting Period will not be eligible. Tri-County Bank’s computer is the official time-keeping device for the Photo Contest.

What to Enter:

For our 2024 Photo Contest, we’d like to see your “View of Michigan” We want to see what Michigan looks like to you, whether it is one of our beautiful lakes, a local park, a farmer in their field, or maybe a beautiful tree in your backyard, we want to see what makes Michigan such a special place to live.

If you choose to include people in your submission, you are responsible for obtaining the necessary releases from the individuals depicted, and must be able to provide copies of those releases to Tri-County Bank upon request.

The following submissions are ineligible:

  • Photos that violate or infringe upon another person's rights, including but not limited to copyright and photographs of persons without the necessary consent required by law in your jurisdiction. Tri-County Bank reserves the right to require entrants to submit evidence of the subject’s legal consent to be photographed for the submitted photograph, which may include a signed waiver from the subject.
  • Photos that contain sexually explicit, nude, obscene, violent or other objectionable or inappropriate content.
  • Images that involve the willful harassment of animals, or damage to the environment by the photographer.
  • Images that involve putting any individual or animal in danger.
  • Tri-County Bank shall determine entry eligibility in its sole and absolute discretion.

By entering this contest, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Tri-County Bank. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party. You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Tri-County Bank from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Tri-County Bank may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

Prize:

The Winner of the photo Contest will be announced on Tri-County Bank’s Facebook page on April 9th and contacted via information provided at the time of entry. The winner will receive $100 in the form of a Tri-County Bank Money Order made payable to the contestant’s name provided to Tri-County Bank during the submission process. The winner may receive entry of their photo into Tri-County Bank’s 2025 calendar (See qualifications to be eligible for the 2025 Tri-County Bank calendar). The winner will receive recognition on Tri-County Banks Website.

How to Enter:

  • Bring in a picture to any Tri-County Bank Branch location listed below:

    Almont, Brown City, Capac, Imlay City, Kingston, Marlette, North Branch, Peck, Yale, Romeo

  • Submit picture on www.tri-countybank.bank under the 2024 photo contest link under the tab labeled Information or email a photo to marketing@tri-countybank.bank

    **1 entry per person** Tri-County Bank reserves the right to reject any additional entries or entries that do not comply with these Official Rules. By entering, you indicate your agreement to, and acceptance of these Official Rules and Tri-County Bank’s decisions. You cannot win a prize unless you comply with all requirements in these Official Rules.

    Calendar Eligibility:

    In order for any photos to be considered for use on the 2025 Tri-County Bank calendar it must meet the following criteria:

  • Digital version of photo must be submitted to marketing@tri-countybank.bank
  • Signed waiver/release must be submitted with photo.

**Photos that meet the criteria above are not guaranteed to be used in Tri-County Bank’s calendar. Final approval of photos used for calendar is at the discretion of Tri-County Bank.

Your Rights:

You will retain all rights to any photograph you submit -- including ownership if applicable.

If you submit a photograph to enter the Photo Contest, you grant Tri-County Bank a royalty-free, nonexclusive right to:

  • Display the photographs on: www.tri-countybank.bank
  • Use the photograph on social media pages and in local newspapers.
  • Use the photograph in Tri-County Bank’s internal and external communications materials including but not limited to monthly newsletters.

Tri- County Bank will credit all photographs with the caption and person’s name when the full name is available.

General Conditions:

In the event that the operation, security, or administration of the Photo Contest is impaired in any way, Tri-County Bank may, in its sole discretion, either: (a) suspend the Photo Contest to address the impairment and then resume the Photo Contest; or (b) award the prize(s) from among the eligible entries received up to the time of the impairment. Tri-County Bank reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Photo Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Tri-County Bank’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Tri-County Bank by mail shall not be deemed proof of receipt of that communication by Tri-County Bank. In the event of a dispute as to the owner of an online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner. The Photo Contest is subject to federal, state, and local laws and regulations and is void where prohibited.

Release and Limitations of Liability:

By entering, you agree to release and hold harmless Tri-County Bank, their officers, directors, and employees (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Photo Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Photo Contest; (b) technical errors; (c) printing errors; (d) late or undelivered mail; (e) errors in the administration of the Photo Contest; or (f) injury or damage to persons or property. You waive the right to claim any attorney fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

“This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. You are providing your information to Tri-County Bank and not to Facebook. The information you provide will be used for this Tri–County Bank photo contest only”

Privacy and Publicity:

Except where prohibited, you consent to Tri-County Bank’s use of your name in any list of winners (if applicable) and for promotional purposes in any media without further payment or consideration.

Disputes:

You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Photo Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Michigan. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Tri-County Bank in connection with the Photo Contest, shall be governed by, and construed in accordance with, the laws of Michigan, without giving effect to any choice of law or conflict of law rules (whether of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Michigan.

By submitting your photo you acknowledge that you agree to these official rules, terms and conditions for Tri-County Bank’s 2023 Photo Contest provided at the time of photo submission. You agree to allow Tri-County Bank to post your photo on Tri-County Bank’s Facebook page, you allow Tri-County Bank to possibly utilize your photo in marketing materials, and/or You allow Tri-County Bank, should they choose, the use of submitted photo for Tri-County Banks annual calendar.
